Detailed description<\/p>\n
The successful candidate will be responsible for, but not limited to, the following key performance areas:<\/p>\n
\tProactively identify, address and manage potential legal risks within the SARB and the PA.
\n\tConduct and integrate legal research.\u00a0 \u00a0
\n\tTake responsibility for monitoring, reviewing and commenting on local and international legislation, regulation and policies that have an impact on the mandate of the SARB and the PA, and advise senior management on any developments.
\n\tSteer legal processes for internal clients on complex legal challenges and disputes affecting their operations.\u00a0
\n\tProvide legal advice, opinions and guidance to the SARB and the PA on legal, regulatory and supervisory matters.
\n\tParticipate in negotiations to draft and conclude agreements on relevant positions, policies, principles, litigation matters and regulatory action matters, in consultation with senior management in the Legal Services Department.
\n\tInitiate legislative amendments or review drafts of new legislation in accordance with standard policies and procedures to address specific concerns of the SARB and the PA.
\n\tLead special projects to ensure that mandated and informed positions are developed and presented to stakeholders.
\n\tSupport and maintain strong professional relationships with panel attorneys\u2019 firms and manage litigation in accordance with standard policies and procedures in conjunction with panel firms.
\n\tConduct research on a wide range of matters, including matters on legislative, regulatory and policy frameworks that have an impact on SARB and the PA.
\n\tTake responsibility for addressing issues pertaining to relevant legislation applicable to the SARB and the PA.
\n\tRepresent the department, the SARB and the PA on national, regional and international committees and report on, and provide guidance, advice and legal opinions to, the above-mentioned committees.
\n\tParticipate in various relevant legal practice groups of the Legal Service Department as a member or as lead.
\n\tContribute to and support the strategic objectives of LSD and the SARB Group.
\n\tReview and draft relevant SARB and PA policies.
\n\tInstitutionalise processes to enhance efficiencies within the SARB and the PA.
\n\tMentor and develop legal counsel.<\/p>\n
Job requirements<\/p>\n
To be considered for this position, candidates must:<\/p>\n
\thave an\u00a0LLB degree or an equivalent appropriate legal qualification and preferably LLM.\u00a0
\n\tbe an admitted attorney, advocate or a corporate lawyer within a corporate or investment banking legal environment or reputable banking and finance legal practice; and
\n\thave 8\u201210 years\u2019 experience as a practicing attorney, advocate or in-house legal counsel.<\/p>\n
The following will be an added advantage:<\/p>\n
\tAdmission as an Attorney or an Advocate of the High Court
\n\texperience in banking regulation
\n\ta solid record in leading and closing complex projects
\n\texperience in company law
\n\texposure to financial market infrastructure, financial technology, exchange control and payment systems<\/p>\n
