{"id":16083,"date":"2025-08-11T12:02:17","date_gmt":"2025-08-11T12:02:17","guid":{"rendered":"https:\/\/jobs.dataaxisnode.com\/southafrica\/job\/principal-legal-counsel-market-inquiry-analyst-market-inquiry-x2-economist-x2\/"},"modified":"2025-08-16T00:24:28","modified_gmt":"2025-08-16T00:24:28","slug":"principal-legal-counsel-market-inquiry-analyst-market-inquiry-x2-economist-x2","status":"expired","type":"job_listing","link":"https:\/\/jobs.dataaxisnode.com\/southafrica\/?post_type=job_listing&p=16083","title":{"rendered":"Principal Legal Counsel : Market Inquiry \n\n\n            \n\n            \n            Analyst : Market Inquiry (x2) \n\n\n            \n\n            \n            Economist (x2)"},"content":{"rendered":"<p>Key Accountabilities<\/p>\n<p>The main responsibilities of the incumbent will, amongst others, include:<\/p>\n<p>\tProvide legal support to the Market Inquiry Division, including conducting research on legal issues and providing sound legal advice to the Divisional Manager and the Market Inquiry Panel.<br \/>\n\tLeading and managing the legal and technical dimensions of market inquiry investigations.<br \/>\n\tGuiding the scope definition, identification of issues, and development of legal-analytical frameworks in inquiries, including the drafting of terms of reference and other legal documents.<br \/>\n\tConceptualise and develop the analytical framework for assessing the issues identified in a market inquiry, including research of international best practices and jurisdictional approaches to similar issues.<br \/>\n\tProvide day-to-day guidance to the technical team of senior analysts, analysts and junior analysts in the market inquiry with regards to legal analysis.<br \/>\n\tLeading the development of information requests, review instruments, and evidence-gathering protocols.<br \/>\n\tManaging, supervising, and evaluating the performance of a multi-disciplinary team of legal and analytical professionals.<br \/>\n\tInterpreting and applying competition legislation to determine whether market features hinder competition or the public interest.<br \/>\n\tDrafting and reviewing inquiry reports actions.<br \/>\n\tTake lead in the formulation of potential remedies required to address competition distortions identified by the market inquiry.<br \/>\n\tTake lead in the monitoring of compliance with the recommendations and remedial actions of a market inquiry.<br \/>\n\tLeading stakeholder engagements, including public hearings and consultations on legal and evidentiary issues.<br \/>\n\tManaging external legal counsel, through the Legal Services Division or directly, and ensure effective case strategy and execution.<br \/>\n\tProviding litigation support for market inquiries, including appearances before the Competition Tribunal and courts.<br \/>\n\tRepresenting the Commission in strategic forums and contributing to capacity building in legal research and compliance.<br \/>\n\tParticipating in Commission planning, committees, and knowledge-sharing platforms.<\/p>\n<p>Requirements<\/p>\n<p>We are looking for a strategic legal professional who meets the following requirements:<\/p>\n<p>\tA completed LLB Degree or equivalent qualification.<br \/>\n\t8 \u2013 10 years post-admission experience, of which at least 3 years preferably includes management or strategic leadership experience.<br \/>\n\tExperience in Competition Law experience and market regulation is essential.<br \/>\n\tStrong drafting, analytical, negotiation and litigation skills.<br \/>\n\tProven research and investigative skills including evidence-based analysis.<br \/>\n\tExperience leading multi-disciplinary teams, managing complex investigations or legal projects and guiding analytical work within a legal framework.<\/p>\n<p>Other considerations:<\/p>\n<p>\tPractical work exposure to area of expertise will be further considered to balance against other requirements<br \/>\n\tA completed Masters qualification will be an added advantage.<br \/>\n\tAdmission as an Attorney or Advocate (completed pupillage if admitted as Advocate) will be an added advantage.<br \/>\n\tPractical exposure to drafting and managing high-impact reports, legal submissions, and litigation strategies will be further considered.<\/p>\n<p>go to method of application \u00bb<\/p>\n<p>Apply via company website ( http:\/\/www.compcom.co.za\/ ) or<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"author":2,"featured_media":0,"template":"","meta":{"_promoted":"","_job_location":"","_application":"","_company_name":"The Competition Commission South Africa","_company_website":"http:\/\/www.compcom.co.za\/","_company_tagline":"The Competition Commission has a range of functions in terms of Section 21 of the Competition Act. Anti-competitive conduct, whether through price-fixing, information exchange or the abuse of a dominant position, has adverse effects on both consumers and the economy. Consumers are deprived of low prices and product choice. The overall economic effect would be a slow or negative economic growth rate, as companies become lazy to compete and innovate. The Commission balances issues related to consumer welfare with the broader social and economic goals outlined in the Competition Act, such as employment, international competitiveness, efficiency and technology gains, as well as the ability of small and medium sized businesses and firms owned or controlled by historically disadvantaged persons to compete. In order to ensure the consistent application of the Act across sectors, the Commission may negotiate agreements with other regulatory authorities, participate in their proceedings and advise, or receive advice from, any regulatory authority. The Commission is independent but its decisions may be appealed to the Competition Tribunal and the Competition Appeal Court. Commissioner, Tembinkosi Bonakele, is the Chief Executive Officer of the Commission and is responsible for the general administration of the Commission and for carrying out any function assigned to it in terms of the Competition Act.
