About The Role <\/p>\n
\tAs a full-time Internal Legal Counsel at HyperionDev, you will be part of our People Operations Department within the Wellness division, working towards ensuring that the company has legally sound policies and practices. You will represent the company and lead our preparedness for all legal matters, providing general counsel to other departments.
\n\tIn this role, you will be required to advise and work on a variety of legal matters arising from the company’s dealings with individual and business customers, employees and contractors, and third parties. Your work will include drafting and reviewing in-house legal documents, drafting and reviewing third-party contracts, agreements and leases, settlement of legal disputes, and research and preparation for ongoing and new cases of litigation at any court of law, tribunal or ombudsman.
\n\tTo excel in this role, you should possess sound legal skills, experience in drafting and reviewing legal documents, a fine attention to detail, excellent time- and task- management skills and high levels of motivation and ambition.<\/p>\n
Responsibilities <\/p>\n
Your responsibilities will include, but not be limited to:<\/p>\n
Reviewing, drafting and managing contracts <\/p>\n
\tReviewing and drafting contracts with employees and contractors
\n\tReviewing and drafting contracts and agreements with third parties, including business clients, service providers and suppliers
\n\tNegotiating and liaising with third parties to finalise contracts
\n\tEnsuring that agreements are finalised, signed by relevant parties, and filed properly for internal reference
\n\tEnsuring that contract end dates, notice periods, and lock-in periods are tracked for renewing agreements<\/p>\n
Developing and reviewing policies and procedures <\/p>\n
\tReviewing our legal terms and privacy and data protection policy for South African and international website users
\n\tReviewing the terms and conditions of use of our service by customers (e.g. refund policy, disenrollment policy, student undertaking)
\n\tReviewing internal workplace\/human resources policies and procedures
\n\tEnsuring that the business meets compliance norms with respect to relevant regulations or regulatory requirements
\n\tResearching legal matters and providing legal opinions
\n\tAssisting in training department leads and employees on internal policies, processes and relevant regulations (e.g. labour law)<\/p>\n
Support in litigation, legal representation and enforcing the company’s rights <\/p>\n
\tNegotiating with third parties over disputes and settlement terms
\n\tSupporting or representing the company at legal hearings, including the CCMA
\n\tServing notice of breach, letters of demand, cease & desist letters through electronic means or via sheriffs, and seeing the matters through to conclusion
\n\tResearch and preparation for ongoing and new cases of litigation at any court of law, tribunal or ombudsman
\n\tPreparation of documents for external counsel containing information pertinent to legal matters, including draft affidavits, pleadings, and notices.<\/p>\n
Legal Administration <\/p>\n
\tDrafting Board resolutions
\n\tEnsuring that all legal correspondence, pleadings and notices are archived
\n\tChecking invoices from external attorneys against services rendered<\/p>\n
Requirements <\/p>\n
Minimum<\/p>\n
\tShould be an admitted attorney\/ qualified LPC
\n\t2+ years of experience in drafting legal documents as a candidate attorney
\n\tStrong writing skills and high attention to detail
\n\tExcellent verbal and written communication skills
\n\tAbility to work independently and meet timelines
\n\tStrong negotiation skills<\/p>\n
Preferred <\/p>\n
\t2+ years of post-admission experience
\n\tPrior experience in a startup \/ tech environment
\n\tPrior experience or knowledge in government procurement legislation<\/p>\n
